The three parties
You are a customer of a local business. The business runs a loyalty program and decides its rewards. Cync provides the software the program runs on.
Your loyalty membership is an agreement with the business, not with Cync. Cync does not set the rewards, does not decide who earns one, and cannot give you a reward the business has not granted.
Joining
Joining is free. You need to give a first name and one way to be reached, and you must accept these terms and the Privacy Policy. Everything else on the join form is optional, including every marketing consent.
If you join the same business twice with the same phone number, you get your existing card back rather than a second one.
How visits and rewards work
- A visit is recorded by a member of staff scanning your card, or entering your code by hand. You cannot add visits to your own card, and neither can anyone else without a staff sign-in.
- Each program sets how many visits earn a reward. When you reach the threshold the reward is banked and the counter rolls over, so you keep earning.
- A banked reward can be redeemed once. The system refuses a second redemption of the same reward.
- Two visits within a short window are refused as a likely duplicate. A manager can override this, and must give a reason, which is recorded.
- A staff member cannot correct a mistake on their own. A manager or the owner can, must give a reason, and the original entry is preserved rather than edited.
What the business can and cannot do
The business can change its rewards, end its program, or remove a membership it believes is fraudulent. What it cannot do is set out in the Acceptable Use Policy. In particular it cannot filter who is asked for a review, and it cannot reward you for leaving a positive one.
If a program ends, the business should honour rewards already earned. Cync cannot enforce that on your behalf.
Fair use
You agree not to:
- use someone else's card or code, or let someone use yours to claim rewards you did not earn
- attempt to add visits or rewards to any card by any means other than a genuine visit
- probe, scan or attempt to break the service, or access another business's or customer's data
- automate access to the service in a way that degrades it for others
Availability, and what is not promised
This software is provided as-is. Cync does not promise it will be available without interruption or free of errors, and does not guarantee that a reward will be honoured — that is between you and the business.
To the extent US law allows, Cync is not liable for indirect or consequential losses arising from use of the service. Nothing here limits liability that cannot lawfully be limited.
Draft note: the liability cap, the governing state, the dispute-resolution mechanism, and whether to include an arbitration clause or a class-action waiver are all decisions for the business and its attorney. They are deliberately left unwritten rather than guessed at.
Ending your membership
You can leave at any time and ask for your information to be deleted; see the Privacy Policy. Leaving forfeits any unredeemed rewards, because the record of them is part of what gets deleted.
Changes
These terms carry a version and a date. Material changes will be shown to you before they apply to your membership.
